Workers' Compensation System Overview

Regardless of the type of injury you have suffered, the Connecticut Workers' Compensation System involves three levels of hearings. Your case begins with an informal hearing. If issues cannot be resolved informally, a pre-formal hearing is held, similar to a Pre-Trial in a Superior Court. If necessary, a formal hearing would follow. Formal hearings are an administrative trial where a Workers' Compensation Commissioner will issue a written decision at the conclusion.

You may then appeal decisions by the Commissioner to the Compensation Review Board. Appeals may then be taken to the Appellate Court and finally to the Supreme Court. Most cases are settled before a formal hearing is reached.

Wrongful Dismissal for Filing a Claim

It is illegal for Connecticut employers to fire, cause the firing of, or to discriminate against an employee in any manner because that employee filed a claim for workers' compensation benefits. If you are facing discharge or discrimination you may be entitled to get your previous job back, payment of any back wages and reestablishment of employee benefits you would have been eligible for had you not been discriminated against or fired.
